<要旨>
本稿では,特許権と公共性のバランスを考える対象として,健康や医療に関する技術を創生するために用いられる,ヒトのゲノム・遺伝子に着目する.遺伝子診断方法や医薬品の開発においては,
特許発明を生みだすためにヒトゲノムという人類の遺産であり公共性の高い情報が用いられているということと,生み出された特許発明が人類の健康維持や医療技術の開発のための公共性の高い利用価値を持つということの両面において,特許と公共性が密に交錯していると見なすことができる.具体的事例として,ミリアッド社のBRCA遺伝子の事例を取り上げ,2013年6月13日の米国連邦最高裁判決や関連する最近の判決を踏まえつつ,何に特許を与えて何をパブリック・ドメインとすべきかという知的財産政策の側面からの検討と,社会に受容されるために企業はどのような特許戦略をとるべきかという企業経営の側面からの検討を行なう.
<Abstract>
In this paper I focus on patents on human genome and genes that are linked
with healthcare technology, to consider balancing patents with public interest.
We have to take care of balancing patents with public interest especially
in development of genetic testing and pharmaceuticals based on genetic
research because of both of the following reasons, (1) during its research
and development human genomic information that is heritage of human beings
is used for making a patented invention and (2) the patented invention
is used for public interest, maintaining human health and advancing medical
technology. As a concrete example I refer to the case of Myriad’s business
of genetic testing for breast and ovarian cancer based on patents on BRCA
genes. Here I discuss the issue of intellectual property policy and of
corporate management. I discuss what should be patented and what should
be in public domain concerning human gene, based on the decision for Association
for Molecular Pathology et al. v. Myriad Genetics, Inc., et al. at Supreme
Court of the United States on June 13, 2013 and related court decisions.
I also discuss how a corporation should manage patent strategy in order
to be accepted by society.
