美術の著作物の模写・模倣・再創:令和2年著作権法改正を踏まえた考察

<要旨>
近現代美術において他者作品に依拠した傑作は数多い.しかし最近の著作権尊重の浸透を受け,そのような作品は制限されていくのだろうか.学説を検討すると,必ずしもそうではないと思われる.第1に,令和2年改正で拡大された「写り込み」の規定は,軽微な付随的著作物を意図的に描き込むことを容認する解釈へ道を拓いた.第2に,原著作物と創作的表現が共通しないように描き込むことで,二次的著作物に該当しない作品創作が可能である.第3に,批評に準じた目的を有し,かつ付随的な利用であれば,美術から美術のような非言語の利用であっても引用として解釈できる可能性がある.
<Abstract>
In modern and contemporary arts, there have been quite a number of masterpieces which exploited other works. However, as the respect for copyright grows lately, is the production of such art works becoming more restricted? It could be concluded not necessarily so, according to copyright expert opinions. First, the enhanced“unwanted item” clause in the 2020 revision of the Copyright Act paved the way to intentionally exploit minor and secondary copyrighted items. Second, you may produce works of art which are not considered derivative works if no common creative expressions exist in the original and the derivative. Third, non-verbal exploitation appearing in an art-to-art case could be interpreted in the same way as a citation if used for a critique-like purpose and exploited as a secondary item.
