<要旨>
本論文は,欧州統一特許裁判所(UPC)における標準必須特許(SEP)とFRAND 条件を巡る紛争の最新動向を分析し,誠実交渉義務の具体的内容と実務上の留意点を明らかにするものである.Panasonic v. OPPO 事件およびHuawei v. Netgear 事件を中心に,UPC 判例が示す交渉過程の履行・証拠化の重要性を検討し,自動車業界への示唆と今後の課題を提示する.
<Abstract>
This paper analyzes recent developments in disputes over Standard Essential Patents(SEPs) and FRAND(Fair, Reasonable, and Non-Discriminatory) terms under the jurisdiction of the Unified Patent Court(UPC) in Europe.
Focusing on the landmark cases Panasonic v. OPPO and Huawei v. Netgear, it examines how UPC decisions have clarified the scope of good faith negotiation obligations and emphasized the importance of documenting and evidencing the licensing process. The study highlights practical considerations for both SEP holders and implementers, including the need for transparent information exchange and timely responses during negotiations. It also explores implications for the automotive industry, where SEP licensing is becoming increasingly critical due to the rise of connected and autonomous vehicles. Finally, the paper outlines future challenges, such as risk management across supply chains and the harmonization of global licensing strategies.
