<要旨>
複数主体が分担して特許発明の構成要件の全部を実施している事案において共同不法行為責任を追及するための規範や判断基準はいまだ確立されているとはいえない.最初に,民法における共同不法行為の成立要件に関する判例や学説を踏まえつつ,複数主体が関与する特許権侵害に関する裁判例や学説を整理し,民法における共同不法行為責任とは異なり,特許権の共同直接侵害の成立には,各自の行為がそれぞれ独立に不法行為の要件を備えることは求められないものの,共同実行の意思が必要であるとの考えが支配的であることを明らかにした.次に,ドイツにおける判例の分析を行い,複数主体が意思連絡なしに部分的に特許権侵害行為に関与する場合であっても,行為間に機能的又は利益的な一体性が認められる場合には共同不法行為の成立を認め得る可能性があることを示した.
<Abstract>
There is still no standard approach to determining liability of patent infringement involving multiple entities. First, the study, based on analysis of court precedents and theories concerning joint tort liability under the Civil Code and joint patent infringement, reveals that the dominant opinion requires a shared intent among multiple entities to place responsibility on them for joint direct patent infringement, however it is not necessary for each entity to independently meet the requirements of tort law. Next, by analyzing cases in Germany, the study suggests that the multiple entities can be accused of the joint patent infringement even without their shared intent if there is functional unity or common interest.
