テキスタイルデザインの意匠権と商標権による保護の可能性について

＜要旨＞
テキスタイルデザインは，アパレル等の商品外観における美感を決定する重要な要素である．本稿ではタータンのようなリピート柄から成るデザインを事例として，権利保護の可能性について検討した．テキスタイルの特性として，アパレル等に素材として用いられることから，完成品でも適切な権利保護が実務上は求められる．そこで，テキスタイルデザインが意匠権又は商標権で権利化されている場合に，当該テキスタイルが素材（部品）として用いられた完成品においても，当該テキスタイルデザインの権利が完成品にも及び得るのか検討を行った．また，商標権による保護に関しては，地模様からなる商標として商標法3条1項6号による拒絶の対象となるが，一定の要件を充足する際は登録が認められる．地模様であることの判断や，その場合の登録適格性の判断論理の課題に関して考察と若干の提言を行った．
<Abstract>
The textile design is one of the most important elements in the fashion because it determines the appearance of a clothing.　Therefor, it is necessary to protect the textile design with intellectual property rights.　This article discusses the following problems taking the repeated patterns textile design : tartan as an example.　Textile have the characteristics of being used as materials.　So even finished products require a right protection in the textile design.　Therefor one problem is whether a “design protection” can be admitted or not when a nonregistered clothing consists of registered textile under the Japan Design Law and Japan Trademark Law.　And another is the suitability about the registration of a trademark solely consisting of a pattern.　Usually a trademark solely consisting of a pattern is not registered due to a lack of distinctiveness in the Article 3（1）（vi） of the Japan Trademark Law.　However, even if a trademark consisting solely of a pattern, the trademark registration may be detected when certain conditions are met.　In this article, the author performs some considerations of the suggestion of the trademark registration system about a trademark solely consisting of a pattern.
